House Bills

  1. HB 1010: Insurance Commissioner’s budget.
  2. HB 1012:  Human Services Budget. During the 2013-2015 biennium, the state will receive $93 million less in federal funding for Medicaid reimbursements and other medical assistance coverage.  This reduction in federal funding is the result of North Dakota’s continued growth in per capita income. The state must make up the loss with state funds.  The budget also includes additional funding to offset increased costs at our rural health clinics (1.4 million) and critical access hospitals (1.28 million); to meet increased needs for chemical dependency treatment and mental illness; and to enhance programs that deliver meals to senior citizens and allow them to remain in their homes. The budget also provides a 4-percent inflationary increase for each year of the biennium to nursing homes, healthcare providers, and providers serving people with developmental disabilities and mental illness. Additionally, we funded a wage increase of 50 cents an hour for frontline caregivers.

  6. HB 1035: Relating to the moratorium on expansion of basic care bed capacity and the moratorium on expansion of long-term care bed capacity.
  7. HB 1036: Relating to the membership and powers of the health care data committee, administrative authority of the health care data committee, and a civil penalty; and to repeal section 23‑01.1‑02.1 of the North Dakota Century Code, relating to the publication of comparative physician fee information.
  8. HB 1037:  Provide for a legislative management study of the autism spectrum disorder.
  9. HB 1038: Provide for the establishment of an autism spectrum disorder registry; and to provide appropriations to the state department of health for an autism spectrum disorder registry and to the department of public instruction for autism spectrum disorder educational training and support.
  10. HB 1039: Provide for the establishment of a voucher system for autism spectrum disorder services and support; and to provide an appropriation.
  11. HB 1040: Relating to the appointment of an emergency guardian; to amend and reenact section 30.1‑28‑09 of the North Dakota Century Code, relating to requirements of guardianship proceedings; and to repeal section 30.1‑28‑10, relating to the appointment of temporary guardians.
  12. HB 1041: Provide appropriations to the office of management and budget and the supreme court for guardianship and public administrator services.
  13. HB 1051: Provide for a workers' compensation review committee study of the workers' compensation preferred provider program.
  14. HB 1052: Relating to the workers' compensation preferred provider program and employer’s obligations for notice to the employees about the details of the preferred provider program to its employees.
  15. HB 1053:  Relating to transparency of medical providers' professional relationships with workforce safety and insurance. If the organization enters a professional relationship with a medical provider, a term of that relationship is that at the time of treatment of a patient who is an injured employee the medical provider has an obligation to inform that patient that the medical provider has a professional relationship with the organization.
  16. HB 1070: Relating to the scheduling of controlled substances.
  17. HB 1071: Relating to licensing procedures to obtain a registration under the Uniform Controlled Substances Act; to amend and reenact sections 19‑03.1‑01, 19‑03.1‑16, and 19‑03.1‑17 of the North Dakota Century Code, relating to controlled substances; and to provide a penalty.  This is a separate licensing program for all providers with DEA licenses and provides for a provider tax of $90.00 every three years to pay for the Prescription Drug monitoring program.
  18. HB 1072: Relating to a criminal penalty for serving as an agent, intermediary, or other entity causing use of the internet to bring together a buyer and seller for dispensing a controlled substance or other specified drug; and to provide a penalty.
  19. HB 1086: Relating to the powers of the board of podiatric medicine in investigating and prosecuting complaints, and allows the board to subpoena witnesses and podiatrists and hospital records.any podiatrist under investigation..
  20. HB 1088: Relating to state health officer written orders.  It provides that such orders issued under this section shall have the same effect as a physician's standing medical order.
  21. HB 1089: This bill allows the department to select one or more nursing homes to operate a unit that exclusively provides geropsychiatric services.  Previous law only allowed two in the state, this bill allows the department to determine if the number of approved geropsychiatric units in the state is insufficient to meet the needs, the department may select a geropsychiatric unit based on the experience, qualification, and capacity of the nursing homes that propose to provide geropsychiatric services.
  22. HB 1091:  This bill revises the nursing practices act to include the following:
  23. HB 1092: Relating to the licensing of audiologists and the composition of the board of examiners on audiology and speech‑language pathology; and to provide an effective date.
  24. HB 1094: Respiratory care is implemented on an order from a licensed physician, certified nurse practitioner, or physician's assistant
  25. HB 1101: Relating to opioid treatment programs. The division of mental health and substance abuse services of the department is designated as the state opioid treatment authority. To operate in this state, an opioid treatment program must be granted a license from the department, certification from the United States department of health and human services substance abuse and mental health services administration, and registration from the United States department of justice drug enforcement administration. The department may license a substance abuse treatment program to operate an opioid treatment program in the state. A separate license is required for each location at which an opioid treatment program is operated under this section.  The department shall adopt rules relating to licensing and monitoring opioid treatment programs, including rules for standards for approval and maintenance of license; assessment of need for an opioid treatment program in the proposed location; patient eligibility for admission to an opioid treatment program; treatment standards, including counseling and drug testing requirements; and measures to prevent the diversion to illegal use of any drug used by a program to treat an opioid addiction.
  26. HB 1102: Relating to the student financial assistance and scholars program.
  27. HB 1108: Relating to medication administration in correctional facilities and allowing the department to approve medication assistant I training and competency evaluation program.
  28. HB 1114: Relating to delegation of the powers of a parent or guardian of a minor or incapacitated person If the parent or guardian is on a military active duty order deploying the parent or guardian away from the individual's home of record, that authority may be delegated to another person, for a period not exceeding twenty - four months.; and to declare an emergency.
  29. HB 1116: Relating to an evaluation to determine a defendant's fitness to proceed.  The bill eliminates human service centers as evaulators. In lieu of detention, the court may allow the defendant to remain in the defendant's present residential setting or other suitable residential setting for the purpose of evaluation by other suitable facility or personnel, but not a human service center, subject to any reasonable limitation the court may impose.

HB 1433: A BILL for an Act to create and enact a new section to chapter 23‑01 of the North Dakota Century Code, relating to hospital bad debt relief grants; to amend and reenact sections 57‑36‑25 and 57‑36‑26, subsection 1 of section 57‑36‑31, and section 57‑36‑32 of the North Dakota Century Code, relating to allocation of tobacco products taxes and the health care delivery trust fund; and to provide an appropriation.
  52. HB 1456 - Relating to limitations on abortion after determination of detectable heartbeat in an unborn child and grounds for disciplinary action for physicians; and provide a penalty.
  53. HCR 3007:  eliminates the Statewide property tax levy of one mill for support of the state medical center at the University of North Dakota; and to provide an effective date.

Senate Bills

  1. SB 2003: Higher education budget.  Includes $68 million appropriation for an addition to the Medical School and endorsement of the healthcare workforce initiative. Associated with Phase 2 of the HWI plan are requests for an additional increase in funding that will allow the school to expand class sizes for medical and health science students as well as add 8 residency slots.
  2. SB 2004:  A BILL for an Act to provide an appropriation for defraying the expenses of the state department of health; and to provide legislative intent.
  3. SB 2021:  ITD budget.
  4. SB 2024: Provide an appropriation for defraying the expenses of the comprehensive tobacco control advisory committee.
  5. SB 2030: Relating to regional public health network definitions, joint powers agreement review, annual plan, and receipt and use of moneys; and to provide an appropriation.
  6. SB 2031: Relating to health districts; to provide for reports; and to provide an appropriation.

  16. SB 2068: Relating to decreasing residential child care facility bed capacity to increase psychiatric residential treatment facility bed capacity.  The bill allows the department may convert residential child care facility bed capacity licensed under chapter 50 - 11 to psychiatric residential treatment facility bed capacity licensed under this chapter. The department may add one psychiatric residential treatment facility bed for every two beds by which it decreases residential child care facility bed capacity. The department may not increase residential child care facility bed capacity by decreasing psychiatric residential treatment facility bed capacity.
  17. SB 2080: Relating to premium payments, workers' compensation premiums, penalties for failure to secure coverage, assignment of claims, and volunteer health practitioner benefits; and to provide for application.
  18. SB 2081: Relating to medical assistance for gestational carriers and providing that the department may not make payment under this chapter for pregnancy-related services, including labor and delivery services, provided to a woman who becomes pregnant for the purpose of bearing a child for another person or couple.
  19. SB 2082: Relating to massage therapy licensure and the board of massage.  This bill would allow a school to charge a fee and students may accept tips under a policy set by the School and allow the board may approve alternate educational methods or methodology for applicants to complete educational requirements if the applicant has graduated from a school of massage that is accredited by a national or regional accrediting agency recognized by the United States department of education.
  20. SB 2083: Relating to exemptions from clinical laboratory practice licensing to include Perfusionists performing clinical laboratory tests for hematology, coagulation, and chemistry during the course of a patient's perfusion procedures and personnel of the division of laboratory services of the state department of health participating in the centers for disease control and prevention's chemical terrorism toxic metals determination program.
  21. SB 2084: Relating to the practice and licensing of dental hygienists and dentists and the ownership of a practice.
  22. SB 2087:  Relating to changing the renewal and late fees for Podiatrists.
  23. SB 2088: Relating to athletic trainers.  This bill changes the definition of athletic trainers to a health care professional who collaborates with physicians to optimize patient and client activity and participation in athletics, work, and life. And includes the practice of prevention, examination and diagnosis, recognition, evaluation, management, treatment
  24. SB 2089: Relating to state board of pharmacy prescription monitoring programs. The board shall establish and update rules to direct dispensers on the version of the American Society for Automation in Pharmacy Rules - Based Standard Implementation Guide for Prescription Monitoring Programs in which the dispensing history must be submitted to the central repository.
  25. SB 2107: A BILL for an Act to amend and reenact sections 14-09-08.10, 14-09-09.26, and 14-09-09.33 subsection 1 of section 14-09-09.34, sections 14-20-18 and 34-15-01, subsection 1 of section 34-15-03, and section 34-15-04 of the North Dakota Century Code, relating to child support and paternity; to repeal section 14-09-08.15 of the North Dakota Century Code, relating to medical support.

  27. SB 2109: CHIP - A BILL for an Act to amend and reenact sections 50-29-02 and 50-29-04 of the North Dakota Century Code, relating to eligibility determinations for the children's health insurance program using modified adjusted gross income methodologies as required in 42 U.S.C . 1396a(e)(14).
  28. SB 2113: At the request of the Adjutant General a BILL to amend section 44-04-18.1 of the North Dakota Century Code, relating to confidentiality of emergency responder peer or group counseling session records relating to critical incident stress management.
  29. SB 2114: At the request of the Department of Human Services - A BILL to enact a new section to chapter 50-24.1 of the North Dakota Century Code, relating to sanctions against a provider who provides services under a provider agreement with medical assistance. A provider, an affiliate of a provider, or any combination of provider and affiliates, is liable to the department for up to ten thousand dollars for each act of fraud or abuse. This sanction is in addition to the applicable rules established by the department. A provider, an affiliate of a provider, or any combination of provider and affiliates, that is assessed a civil sanction by the department also shall reimburse the department investigation fees, costs, and expenses for any investigation and action brought under this section.
